These Terms of Use (the “Terms”) govern your access to and use of the websites, applications, and digital platforms operated by Murabaha Inc., operating as Manzil, together with its affiliated entities (collectively, “Manzil,” “we,” “us,” or “our”), including www.manzil.ca (the “Site”).

By accessing or using the Site, you confirm that you have reached the age of majority in your jurisdiction, have the legal capacity to enter into binding obligations, and agree to be bound by these Terms. If you do not agree, you must not access or use the Site.

These Terms apply only to your use of the Site and do not replace or modify any other agreements you may have with Manzil relating to specific products or services, which are governed by separate agreements.

Nothing in these Terms of Use is intended to exclude, limit, or waive any mandatory rights or protections available to consumers under applicable law, including the Quebec Consumer Protection Act and applicable privacy legislation, where such laws apply.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Manzil will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, data, or business opportunities, arising from or related to your use of or inability to use the Site.

Where liability cannot be excluded, Manzil’s total aggregate liability arising out of or relating to these Terms or your use of the Site will not exceed one hundred Canadian dollars (CAD $100) per claim or series of related claims, unless otherwise required by applicable law.

11. Indemnification

You agree to indemnify and hold harmless Manzil and its affiliates, directors, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses arising out of or related to your use of the Site or breach of these Terms.

12. Termination

These Terms remain in effect until terminated. You may stop using the Site at any time. We may suspend or terminate your access to the Site immediately, without notice, if we believe you have breached these Terms or where required for legal, security, or operational reasons.

Termination or suspension of access does not affect any obligations or liabilities accrued prior to such termination or suspension.

13. Governing Law and Jurisdiction

Except as restricted by applicable law, these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in Toronto, Ontario.

For Quebec consumers, mandatory consumer protection laws may apply, and jurisdiction may be determined in accordance with applicable Quebec law.

Nothing in this section limits a consumer’s right to bring proceedings in a jurisdiction mandated by applicable consumer protection law.

14. General Provisions

These Terms constitute the entire agreement between you and Manzil regarding the Site and supersede all prior agreements or understandings relating to the Site.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision does not constitute a waiver.

Any suggestions, feedback, ideas, or recommendations you provide to Manzil regarding the Site may be used by Manzil without restriction or compensation to you, and you grant Manzil a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate such feedback for any purpose.
